Q1. Last week, the Trump administration brought Kilmar Abrego Garcia back to the US to face charges of unlawfully transporting unauthorized immigrants.

Abrego Garcia, a native of El Salvador, had entered the US illegally in 2012, was arrested on gang charges in 2019, wherein he applied for asylum and a judge ruled he couldn’t be deported to his home country citing the threat of gang violence to his family.

In March 2025, he was arrested on gang allegations and deported to a Salvadoran prison. In April a court ordered he be brought back to get a hearing. The Trump administration had said both that they would follow all court orders, and that Abrego Garcia would never be back in the US.

Q2. The new charges against Abrego Garcia allege he and co-conspirators trafficked undocumented migrants, often picking them up in the Houston area shortly after they had crossed the border and transporting them to other parts of the country.

The indictment cites a traffic stop video from 2022 in which Abrego Garcia was pulled over for speeding while driving with eight other individuals about 80 miles from Nashville, TN. He said he was driving fellow construction workers, and wasn’t charged. At one point in the video a second trooper told the first he believed Abrego Garcia was trafficking the people in the car.

The indictment alleges Abrego Garcia told the trooper they had "been in St Louis for two weeks doing construction" and were returning to Maryland, but that license plate reader data showed the car had not been near St Louis for 12 months but had been in Houston, and there were no construction tools in the car.

The indictment also relies heavily on information from six unnamed co-conspirators, at least one of which was incarcerated for smuggling and deported, only to return to the US at a later date.

In a press conference, Attorney General Pam Bondi described allegations against Abrego Garcia that were not included in the indictment, including allegations by co-conspirators he "solicited nude photographs of a minor" and "played a role in a murder." Attorneys general from both parties have generally accused defendants of crimes only for which a grand jury indicted them, lest they unfairly harm defendants’ reputations.
